Terms of Use

Beacon is a voluntary social exercise built around sharing inspiration and recording the approximate journey of physical Beacons. Please use the service and handle every Beacon thoughtfully, safely, and lawfully.

1. Who operates Beacon

These Terms apply to the Beacon website, its public journey pages, and related services operated by Beacon Project (“Beacon,” “we,” “us,” or “our”). Questions may be sent to privacy@tokeninspiration.com.

2. Accepting these Terms

By accessing or using Beacon, you agree to these Terms. If you do not agree, do not use the service or submit information. Some rights and protections provided by the law where you live cannot be waived; nothing in these Terms is intended to remove those rights.

3. What Beacon does

A physical Beacon may deliver a changing inspirational message when tapped, allow a finder to add an approximate journey point, accept an optional note, and offer an optional way to request future journey updates. Beacon does not promise that any particular object will continue traveling, that every stop will be recorded, or that maps and statistics will always be complete or accurate.

4. Safe and lawful placement

When moving or placing a Beacon, use good judgment and follow all local laws, property rules, posted instructions, and requests from property owners or staff.

  • Do not trespass or enter restricted areas.
  • Do not place a Beacon in roadways, rail areas, airport security areas, government or military facilities, emergency facilities, schools without authorization, or any location where an unfamiliar object could reasonably cause alarm.
  • Do not obstruct doors, walkways, accessibility routes, equipment, signs, or public services.
  • Do not hide a Beacon in food, merchandise, mail, personal belongings, vehicles, or another person’s property.
  • Do not place a Beacon where it is likely to create a hazard, be mistaken for a dangerous device, or violate another person’s privacy.
  • If a property owner, employee, public official, or other responsible person asks you to remove it, do so promptly.

You are responsible for choosing a safe and appropriate location. Beacon may retire or disable a Beacon that is used unsafely, unlawfully, or contrary to these Terms.

5. NFC tags and technical use

Do not alter, overwrite, clone, redirect, disable, or tamper with a Beacon’s NFC tag or web address. Do not use the service to distribute malware, collect credentials, impersonate Beacon, interfere with security, scrape personal information, overwhelm the service, or attempt unauthorized access.

6. Optional submissions

You may choose to submit a journey location, note, nickname, profession, home region, or similar information. Do not submit sensitive personal information, exact home addresses, private contact information, unlawful material, threats, harassment, discriminatory content, confidential information, or content that belongs to someone else.

You keep ownership of content you submit. You give Beacon a non-exclusive, worldwide, royalty-free license to store, moderate, reproduce, translate, and display that content only as reasonably necessary to operate, improve, protect, and explain the Beacon project. We may remove or decline to display submissions.

7. Journey maps and location information

Public journey maps are intended to be approximate. A displayed point may be rounded, generalized, delayed, omitted, or removed to protect privacy and safety. Do not rely on a Beacon map for navigation, emergency response, proof of presence, or any legal or commercial purpose.

8. Journey-update emails

Journey updates are optional and require a separate request and consent. Update frequency is not guaranteed. When updates begin, each message will identify the sender and provide a way to unsubscribe. Journey-update consent does not authorize unrelated advertising or a general marketing list.

9. Intellectual property

The Beacon name, logos, site design, original messages, software, and project materials are owned by or licensed to Beacon Project, except for third-party material identified as such. These Terms do not grant permission to copy, sell, manufacture, or commercially exploit Beacon materials or branding.

10. Availability and changes

The service may be changed, suspended, limited, or discontinued at any time. We may change a Beacon’s status, remove content, correct data, or modify these Terms when reasonably necessary. Material changes will be reflected by a new effective date.

11. Disclaimers

Beacon is provided on an “as is” and “as available” basis. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and uninterrupted operation. Inspirational messages are general in nature and are not medical, mental-health, legal, financial, safety, or professional advice.

12. Limitation of liability

To the fullest extent permitted by applicable law, Beacon Project will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, opportunity, goodwill, or profits; or injury, loss, or damage arising from the placement, movement, loss, discovery, or handling of a physical Beacon. This limitation does not apply where liability cannot lawfully be excluded or limited.

13. Governing law

These Terms are governed by the laws of Washington, United States, without regard to conflict-of-law principles. Any exclusive forum or governing-law provision is subject to mandatory consumer protections and non-waivable rights available in the place where you live.
